1. Acceptance of Terms

By accessing or using HIAFAN ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users, including visitors, registered users, and anyone who accesses the App. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Service

HIAFAN is a sports social media platform that allows users to:

  • View live sports scores and game information

  • Post and share content ("Hoots") about sports

  • Interact with other sports fans through comments and votes

  • Follow favorite teams and receive updates

  • Participate in game-specific discussion zones ("The Zone")

The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the service at any time.

3. User Accounts

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete registration information

  • Maintain the security of your password

  • Notify us immediately of any unauthorized use of your account

  • Be responsible for all activities under your account

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. User Content

You retain ownership of content you post ("User Content"). By posting content, you grant HIAFAN a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute your content in connection with the service.

You are solely responsible for your User Content and agree not to post content that:

  • Is unlawful, harmful, threatening, or harassing

  • Infringes on intellectual property rights

  • Contains spam or unauthorized advertising

  • Impersonates others or misrepresents your affiliation

  • Contains malicious code or viruses

  • Violates the privacy of others

5. Community Guidelines

To maintain a positive environment, users must:

  • Treat others with respect and civility

  • Not engage in harassment, bullying, or hate speech

  • Not post misinformation or misleading content

  • Not spam or post excessive promotional content

  • Respect the intellectual property of others

  • Report violations rather than engaging with violators

Violations may result in content removal, temporary suspension, or permanent ban.

6. Intellectual Property

The App and its original content, features, and functionality are owned by HIAFAN Inc. and are protected by international copyright, trademark, and other intellectual property laws.

Sports data, team logos, and related content are property of their respective owners and leagues. Our use of such content is for informational purposes and does not imply endorsement.

7. Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for:

  • The content or practices of third-party services

  • Any damage or loss caused by third-party services

  • The availability of third-party services

Your use of third-party services is at your own risk and subject to their terms.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Accuracy of sports data

  • Uninterrupted or error-free service

Sports scores and data are provided for informational purposes and may not be real-time or accurate.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIAFAN AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, or consequential damages

  • Loss of profits, data, or goodwill

  • Service interruption or data loss

  • Any damages exceeding $100 or the amount you paid us

Some jurisdictions do not allow these limitations, so they may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless HIAFAN, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the App

  • Your User Content

  • Your violation of these Terms

  • Your violation of any rights of another

11. Termination

We may terminate or suspend your account at any time, without notice, for:

  • Violation of these Terms

  • Conduct we deem harmful to other users

  • Conduct we deem harmful to the App or HIAFAN

  • Any reason at our sole discretion

Upon termination, your right to use the App ceases immediately. Sections 4, 7, 9, 10, and 11 survive termination.

12. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Sacramento County, California.
